Understanding Status Codes
Every trademark application and registration in the USPTO database has a three-digit status code that indicates its current state. These codes are organized into four main categories:
Registered
The trademark is registered and currently active. The owner has exclusive rights to use the mark.
Registered - Backfile
Backfile registration that is active.
Registered
Mark is registered on the Principal Register.
Section 8 Accepted
Declaration of continued use (Section 8) accepted.
Section 8 & 15 Accepted
Declarations of continued use and incontestability accepted.
Renewed
Registration renewed under Section 9.
Section 8 & 9 Accepted
Declarations of continued use and renewal accepted.
Section 71 Accepted

Frequently Asked Questions
What does "Registered" status mean?
A "Registered" trademark is currently active and protected. The owner has exclusive rights to use the mark for the goods/services covered. The owner must file maintenance documents (Section 8 declarations and renewals) to keep the registration active.
What's the difference between "Abandoned" and "Cancelled"?
Abandoned means the application was abandoned before it became a registration, typically due to failure to respond to Office actions or file required documents. Cancelled means a registration was issued but later terminated through expiration, non-renewal, or cancellation proceedings.
Can an abandoned application be revived?
In some cases, yes. If an application was abandoned unintentionally, the applicant may file a petition to revive within certain time limits. Status code 612 indicates a revival petition is pending. If granted, the application returns to pending status (616).
What is Section 8 and Section 9?
Section 8 requires trademark owners to file a declaration of continued use between the 5th and 6th year after registration, and again at each 10-year renewal. Section 9 is the renewal application filed every 10 years. Failure to file results in cancellation (status code 710).
What is Section 15 (Incontestability)?
Section 15 allows owners to file a declaration of incontestability after 5 years of continuous use, providing stronger legal protection. Status code 702 indicates both Section 8 and Section 15 declarations have been accepted. Once filed, the registration becomes much harder to challenge in court.
