The Examiner raises a substantive issue with regards to US Serial Number 99165316. The overriding concern is not only to prevent buyer confusion as to the source of the goods and/or services, but to protect the registrant from adverse commercial impact due to use of a similar mark by a newcomer. The proposed solution to the substantive issue the Examiner raises is to amend the Statement of Services to narrow the scope of Hudur Institute's aims. To clarify, Hudur Institute provides services to spiritual seekers interested in the esoteric Sufi teachings of Islam by means of monthly private gatherings and weekend retreats, lectures and discussions of methods of meditation, prayer, and cultivation thereby of a sense of the presence (hudur) of Allah ta'ala (Almighty God) These activities are broadcast to participants live by means of Zoom and edited and published on a YouTube channel. In addition, daily question-and-answer sessions are conducted on private WhatsApp groups. In contrast, the activities of Presence Neuro, Inc. appear to be primarily or strictly secular. Although Presence's statement makes reference to "workshops in group or individual in the field of spiritual, personal and professional transformation," the statement as a whole makes it clear that its programs will target "customers" of primarily secular interests, and Presence's statement, beginning with the words, "Entertainment services," makes no reference to any grounding or basis in a religious creed or organization.The Hudur Institute website and Youtube channel make it clear that all activities and programs are grounded in Islam and not likely to be confused as offerings by Presence Neuro, Inc.'s secular offerings.
